Theft & Warning Level Systems

The staff here in the HBAD are always working to make sure that this is a safe and user-friendly environment for art sales, art trades, coding buying and selling, and off topic / general discussion. however, as with any other social/networking/forum site or online community, there are always going to be users who do not follow, or simply break the rules and TOS. Below is an in depth guideline of our Theft and Warning Level Systems, so that everyone knows what actions receive what repercussions. We want everyone to be informed of the systems so that hopefully there will be less theft and less TOS violations. After all, that is what led to imvu halting sales in both the HBAD Forum and GASR Forum.



Warning Level Bars

every user has a warning level bar to accompany their profile. these bars are what help staff and other users determine the trustworthiness and TOS violations presented by each user.

everyone starts out with a fully filled (100%) warning bar. the more infractions you make against the TOS, the lower the filled percentage. for some infractions, you will receive warnings before any action is taken with decreasing the warning bar level. for others, it will be an instant drop in percentage from 50% to ban, depending on the severity of the violation(s). multiple small violations will result in either a drastic drop in percentage or a ban.

Minor Violations
Minor TOS violations will receive a total of 3 warnings before any action is taken against your warning level. after 3 warnings (on the 4th warning), your warning bar level will be decreased to 75%, on the 5th warning, your warning bar level will be decreased to 50% and you will receive a 2 week ban from the forum. if after the 2 week ban, you continue to make minor violations, you will be permanently banned from the hbad forum website.

minor violations include:


  • posting spam anywhere on the forum
  • posting chain letters
  • excessive profanity
  • posting images that are over 700x500px
  • multi-posting or excessive "bumping" of a topic
  • being rude and/or "trolling"
  • creating excessive topics


Moderate Violations
Moderate TOS violations will receive a total of 1 warning before any action is taken against your warning level. On the second warning, your warning bar level will be decreased to a 50%, on the 3rd warning it will be decreased to 25% and you will receive a one week ban from the forum. if the violations continue after the ban from the 3rd warning, you will be permanently banned from the hbad forum website.

moderate violations include:


  • posting inappropriate content (non-GA material), including sexual content, lewd images, drug/alcohol related images, excessive blood/violence, excessive swearing or other unsuitable content to younger members who use/view this forum website
  • mild slandering of another person, user or otherwise
  • being excessively rude to shop owners, shop customers, or general users


Severe Violations
Severe TOS violations will receive 1 warning, plus a warning bar decrease to 50%. on the second warning, you will receive a 3 week ban from the forum and your warning bar level will be dropped to 25%. if after the 2nd warning and 2 month ban, you continue to violate the TOS, you will be permanently banned from the hbad forum website.

severe violations include:


  • harassment, bullying or threats toward other persons, user or otherwise
  • impersonation of a user or staff member
  • attempting to moderate the forum through rude posts





Theft

[size=9]• Under no circumstances will any stolen/unoriginal graphics and/or coding be sold in the HBAD. your work MUST be 100% original and created by you unless written permission has been given by the original artist to alter their work.
9- Theft policy
   • ANY theft, whether it be images, coding, layout concept/style/design, etc. in ANY form of theft (redistribution, public personal use, etc.) is NOT TOLERATED
   • again, THEFT WILL NOT BE TOLERATED
   • and, just so we are really clear, no stealing, copying, thievery, theft, etc.
although in the TOS it clearly states (twice) that theft of any kind is not allowed, we're letting you know what happens if you do decide to break this rule. there are different kinds of theft, some worse than others, so each will be listed below with the severity and the consequences that go along with the theft.

Moderate Theft Infractions

moderate theft infractions will result in the user being banned from the forum for 3 weeks, and the users warning level bar decreased to 75%. if the moderate theft continues once more, the user will be permanently banned from the HPBD forum website.

moderate theft infractions include:


  • copying the idea of a layout image and distributing it or using it for your own public use
  • obvious copying of the basic elements of another user's style sheet or css coding and distributing it or using it for your own public use


Major Theft Infractions

major theft infractions will result in the user being permanently banned from the hbad forum website. no warnings, no chances. this is a severe infraction, and will not be taken lightly.

major theft infractions include:


  • copying and pasting the elements of another user's layout image onto your own layout design and distributing it or using it for your own public use
  • copying the whole layout image of another user and distributing it or using it for your own public use
  • copying advanced coding (anything more than the basic elements, i.e. style sheet or basic css) and distributing it or using it for your own public use
  • sharing another users original coding with a friend, acquaintance, other user, etc. without the owners written permission



Theft Cases

Every user that reports a theft will have their evidence against the other user compiled into a case that is reviewed by the moderators and administrators. the case remains open for five days so that all the staff members have a chance to review both parties' pieces of evidence and can cast an educated and non-biased vote on the innocence or guilt of the accused thief. every user that is accused of a theft will be notified of the theft case opened against them and are given a 24 hour period to gather their evidence of innocence after a case is opened and the accused have been notified. however, is the accused has blatantly or obviously infringed upon a copyright, the user will be banned immediately and the content will be removed.

forms of evidence to include (as many as possible)


  • bilateral (side by side) comparison
  • videos
  • screen snapshots
  • other photograph evidence
  • chat logs
  • time stamps
  • copyright permissions
  • receipts


while a case is open, any shops the accused user has open will be locked after 12 hours of notification. if the user is found guilty of theft, the shop(s) will be deleted. if the user has been found innocent, the shop(s) will be unlocked and no ban/warning bar level action will be taken

**please note: ALL users receiving bans, except for those that have obviously and blatantly infringed upon a copyright, will be notified 12 hours before the ban takes effect.**
